2. Purpose

These General Terms and Conditions govern the services offered through the Fertyfinder platform, which include:

  • Information and self-assessment tools relating to assisted reproduction treatments.
  • Access to information about fertility clinics and assisted reproduction centres.
  • Optional personalised consultation services (“one-on-one consultation”) with assisted reproduction advisors.

Access to and use of the platform imply full and unconditional acceptance of these terms and conditions.

All services offered through Fertyfinder are provided exclusively online and remotely, through digital tools, forms, informational content and/or scheduled calls or video calls.

3. Nature of the service

Fertyfinder is an information and guidance platform relating to assisted reproduction.

The information provided through:

  • the self-assessment tool,
  • the published content,
  • recommendations regarding countries or clinics,
  • and personalised consultations,

is provided for informational and guidance purposes only.

Fertyfinder and MEDINAMIS MGMT, S.L.:

  • do not provide medical services,
  • do not make diagnoses,
  • do not prescribe treatments,
  • and do not replace the advice of qualified healthcare professionals.

The decision to choose and undergo medical treatment rests exclusively with the user and the selected clinic.

The personalised consultations offered through the platform are provided exclusively remotely using online communication tools.

4. Requirements for use

Access to and use of Fertyfinder services are reserved for persons over 18 years of age who have sufficient legal capacity to enter into contracts.

By using the platform, the user declares and warrants that:

  • they are at least 18 years old,
  • the information provided is truthful and up to date,
  • and they use the platform for personal and lawful purposes.

MEDINAMIS MGMT, S.L. reserves the right to suspend or cancel access for users who breach these terms and conditions or provide false or inaccurate information.

5. Services subject to payment

Some services offered through the platform may be subject to payment, in particular personalised consultations with specialised advisors.

Before confirming the purchase, the user will be able to consult:

  • the total price of the service,
  • the approximate duration,
  • the language of the consultation,
  • and the applicable specific terms and conditions.

Prices will be stated in euros (€) and will include legally applicable taxes, unless expressly indicated otherwise.

6. Purchase process

Services will be purchased electronically through the platform according to the following process:

  1. Selection of the service.
  2. Entry of the required information.
  3. Confirmation of the booking.
  4. Payment of the applicable amount.
  5. Receipt of confirmation by email.

The user declares that the information provided is accurate, complete and truthful.

MEDINAMIS MGMT, S.L. reserves the right to cancel requests or bookings where there are reasonable indications of fraud, misuse or incorrect information.

7. Payment terms

Payments shall be made using the payment methods available on the platform from time to time.

The platform will use secure third-party payment service providers. Fertyfinder does not store complete bank card details.

The purchase shall be deemed completed only once payment has been successfully confirmed.

8. Cancellations and right of withdrawal

In accordance with European consumer protection legislation, the user may exercise their right of withdrawal within 14 calendar days following the purchase, except where:

  • the service has been fully performed,
  • performance has begun with the user's express consent.

In the case of scheduled appointments:

  • the user may request changes or cancellations at least 24 hours in advance,
  • unless different specific terms are indicated at the time of booking.

Cancellations made outside the applicable time limit may not entitle the user to a refund.

9. User obligations

The user undertakes to:

  • use the platform lawfully and in good faith,
  • not engage in fraudulent use or use that may cause harm to third parties,
  • not upload or introduce unlawful, offensive or otherwise non-compliant content,
  • and not use information from the platform for unauthorised commercial purposes.

10. Intellectual property

All Fertyfinder content, including texts, designs, logos, images, software and the structure of the platform, is protected by intellectual and industrial property rights.

Reproduction, distribution, modification or exploitation without the express written authorisation of MEDINAMIS MGMT, S.L. is prohibited.

11. Data protection

Personal data will be processed in accordance with the provisions of the platform's Privacy Policy and with the General Data Protection Regulation (GDPR).

12. Disclaimer of liability

MEDINAMIS MGMT, S.L. does not guarantee:

  • the permanent availability of the platform,
  • the absence of technical errors,
  • or the absolute accuracy and continuous updating of all published information.

Information relating to clinics, treatments and legal frameworks may change over time and should be confirmed directly by the user with the relevant entities.

MEDINAMIS MGMT, S.L. shall not be liable for:

  • medical decisions made by the user,
  • treatments carried out by third parties,
  • clinical outcomes,
  • or any damage arising from decisions based on the information provided on the platform.

13. Amendments

MEDINAMIS MGMT, S.L. may amend these General Terms and Conditions at any time.

The new terms and conditions shall apply from the date of their publication on the platform.

14. Applicable law and jurisdiction

These terms and conditions shall be governed by Spanish law.

For any dispute arising from the interpretation or performance of these terms and conditions, the parties submit to the courts of Barcelona, unless applicable consumer protection legislation provides for another mandatory jurisdiction.
